Polari Terms of Use

These Terms of Use apply to your access to and use of Polari, including the Polari mobile app, website, related services, content, features and any associated digital products we provide.

By using Polari, you agree to these Terms. If you do not agree, you should not use Polari.

Polari is an educational and cultural app designed to preserve, teach and celebrate Polari, the historic queer language. The app may include dictionary entries, word collections, filters, favourite words, quizzes, learning tools, illustrations, written content and related features.

Polari is provided by Lorem Ipsum Creative (ABN 28 874 843 718), referred to in these Terms as “Polari”, “we”, “us” or “our”.

Polari is intended for audiences aged 15 and over. Some of its historical and cultural material includes mature themes, explicit language and references that may not be suitable for younger audiences.

Before using Polari for the first time, you must acknowledge the content advisory and confirm that you are aged 15 or over. Entries containing mature themes may display a 15+ content marker as an additional notice. This marker is a content advisory, not a separate age category or restriction.

If you are under the age of majority where you live, you should only use Polari with the consent of a parent or guardian.

Some features require you to create an account or sign in. You agree to provide accurate information and keep your login details secure.

You are responsible for activity that occurs through your account unless that activity was caused by our failure to take reasonable security measures.

You must not share your account, impersonate another person, create an account using false information or use another person's account without permission.

If you believe your account has been accessed without your permission, contact us promptly.

You agree to use Polari respectfully and lawfully.

You must not:

• Copy, scrape, reproduce or redistribute substantial parts of Polari or its content without permission;

• Use Polari for unlawful, abusive, discriminatory, harassing, misleading or harmful purposes;

• Attempt to interfere with, damage, reverse-engineer, overload or disrupt Polari, our systems or our service providers;

• Attempt to access data, accounts, systems or areas of Polari that you are not authorised to access;

• Submit malicious code or harmful content through any text form in Polari;

• Use automated tools, bots or scripts to access Polari without our written permission;

• Remove copyright notices, trade marks or attribution from Polari content; or

• Use Polari in a way that infringes the rights of another person or organisation.

Polari includes historical, linguistic, educational and cultural material. Some words, phrases or examples may reflect historical usage, reclaimed language, queer history, slang, humour, coded communication, social context or past discriminatory environments.

We aim to present content thoughtfully and respectfully. However, language evolves, historical terms may carry different meanings in different communities, and some content may not suit every user.

Polari is intended for education, preservation and cultural appreciation. It should not be used to mock, stereotype, harass, exclude or demean any person or community.

Unless otherwise stated, all app content and editorial material in Polari, including dictionary entries, explanations, artwork, illustrations, interface design, logos, branding, text, collections, quizzes and other materials, is owned by us or licensed to us.

Software source code that is expressly released under a separate repository licence is governed by that licence. Making a repository publicly visible does not, by itself, grant permission to reuse Polari's content, branding, artwork or editorial material.

You may use Polari for personal, non-commercial use.

You must not copy, publish, sell, license, modify, adapt, distribute, scrape, train AI systems on or create derivative works from Polari content without our prior written permission, except where permitted by law.

Polari lets you submit text through the Feedback form and the Suggest Edit form on a dictionary entry. You can also save favourites and accumulate quiz and learning progress against your account.

You keep ownership of anything you submit, but you give us a worldwide, non-exclusive, royalty-free licence to host, store, use, reproduce and adapt it only to the extent reasonably necessary to review, moderate or respond to it, operate and improve Polari, and correct or improve dictionary entries.

An automated process may write a summary of unreviewed suggested corrections into Polari's public source-code repository. The intended summary contains only the relevant dictionary entry name and the number of suggestions awaiting review. It does not contain suggestion text, your name, email address, account identifier or whether you were signed in.

Feedback messages are not published.

You must only submit content that you have the right to provide. You must not submit unlawful, infringing, abusive, misleading or harmful content.

Please do not include personal or sensitive information in a suggestion or feedback message. If you do, we may process that information only as reasonably necessary to review, respond to, moderate, store or remove the submission in accordance with our Privacy Policy and applicable law.

We may remove or restrict content if we reasonably believe it breaches these Terms, creates risk or affects the safety, integrity or operation of Polari.

Our Privacy Policy explains how we collect, use, store, disclose and protect personal information, including the additional rights and safeguards that apply where the European Union General Data Protection Regulation (GDPR) applies.

Agreement to these Terms is not consent to every use of personal information. Where consent is legally required, we will ask for it separately.

Polari currently uses:

• Supabase for authentication, database hosting, file storage and edge functions;

• Vercel for hosting, deployment and web infrastructure; and

• GitHub for source-code hosting and the automated review process described in Section 7.

These providers may process technical or personal information on our behalf so that Polari can function. Their own terms and policies may also apply to their services. We may add, replace or remove providers from time to time and will update our Privacy Policy where required.

Polari also links to independent third-party websites and reference sources. We do not control those services and are not responsible for their content or privacy practices.

If you download Polari through the Apple App Store, Google Play Store or another platform, that platform's own terms, rules and policies may apply in addition to these Terms.

The app store provider is not responsible for Polari's content, support, maintenance, privacy practices or legal compliance, except where the platform's own terms or applicable law say otherwise.

Polari is currently free and offers no paid features, subscriptions or in-app purchases. No payment provider is integrated.

If we introduce paid features in future, we will show the price, billing period, renewal terms and cancellation process before purchase and update these Terms first.

We may update, improve, suspend, remove or change parts of Polari at any time. We may also fix bugs, add or remove features, change content, adjust compatibility or stop supporting older app versions.

We aim to keep Polari available, but we do not guarantee that it will always be uninterrupted, error-free or available on every device, operating system or network.

We take reasonable steps to protect Polari and user information, including row-level access controls on user data, reputable infrastructure providers and appropriate technical and organisational safeguards.

However, no digital service can be guaranteed to be completely secure. You are responsible for keeping your account credentials confidential and using secure devices and networks.

You may stop using Polari at any time. You can delete your account by opening the Account tab and choosing Delete Account.

Deleting your account does not always require the immediate deletion of every record. We will delete or de-identify associated personal information when it is no longer necessary for the purposes described in our Privacy Policy, unless applicable law permits or requires us to retain it. De-identified or genuinely anonymous information is no longer personal information and may be retained, including as part of Polari's editorial record.

We may suspend or terminate your access if we reasonably believe that you have breached these Terms, created risk for other users or Polari, used Polari unlawfully or interfered with its proper operation.

Where reasonable, we will give notice before suspension or termination. In urgent or serious cases, we may act immediately.

Polari is provided on an “as is” and “as available” basis.

We aim to provide accurate, useful and thoughtful content, but we do not guarantee that every entry, explanation, translation, example or historical note will be complete, current or error-free.

Polari is provided for general educational and cultural purposes. It is not professional, legal, linguistic, academic or historical advice.

To the maximum extent permitted by law, and subject to the consumer guarantees and other rights that cannot lawfully be excluded, we are not liable for indirect, incidental, special or consequential loss, loss of data, loss of profits or loss of goodwill arising from your use of or inability to use Polari.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under applicable law, including under the Australian Consumer Law.

Where we are permitted to limit liability, our liability is limited to resupplying the relevant service or paying the cost of having the service supplied again, to the extent permitted by law.

You agree to indemnify us against reasonable loss, damage, cost or expense to the extent arising from your breach of these Terms, unlawful use or misuse of Polari, or infringement of another person's rights, except to the extent caused or contributed to by our breach, negligence or unlawful conduct.

We may update these Terms from time to time.

If changes are material, we will take reasonable steps to notify you, such as through Polari, by email where appropriate, through our website or by updating the effective date.

Your continued use of Polari after the updated Terms take effect means you accept the updated Terms.

These Terms are governed by the laws of Victoria, Australia.

The courts of Victoria, Australia have jurisdiction over disputes relating to these Terms or your use of Polari, unless another law gives you a mandatory right to bring a claim elsewhere.
